In Ontario, the Honourable Mr. Justice Cullity certified the action as a
class proceeding on February 6, 2007. The Defendants have received leave to
appeal certain issues with respect to the decision and that appeal was
scheduled to be heard on February 22, 2008.
In Quebec, where the action was certified on July 10, 2006, a court date
was scheduled for March 5, 2008 to determine a timetable for the next steps
in the action.
In British Columbia, the action is ongoing. Poyner Baxter continue to
work with the national class counsel team. The progress in the actions in
Ontario and Quebec have an effect on the steps that will ultimately be taken
in British Columbia.

Class
action suits have been filed in British Columbia, Alberta, Ontario and
Quebec. Poyner Baxter LLP is working with the national class counsel team
to ensure the most effective representation possible for the class.
In Quebec, the class
action, which includes residents of the Province of Quebec, was certified on
July 10, 2006.
In Ontario, the class
action certification motion, which will include the residents of all
provinces and territories excluding Quebec, B.C. and Alberta, was heard
before The Honourable Mr. Justice Cullity on November 22 – 27, 2006. On
November 27, 2006, Mr. Justice Cullity announced that he had reserved his
decision. It may take several months before his decision is released.
The case management judge
assigned to the class action in British Columbia is The Honourable Mr.
Justice Kelleher. There are no hearings scheduled in British Columbia at
this time. Further dates will be scheduled once Mr. Justice Cullity’s
decision has been released.

Poyner Baxter has filed a
class action lawsuit against Eli Lilly Canada Inc. and its U.S. affiliate
Eli Lilly and Company. Eli Lilly researched, developed, manufactured, sold, distributed and/or marketed a drug called
Zyprexa (also known as Olanzapine) in Canada.
Zyprexa is
among a group of drugs called the “atypical antipsychotic drugs” prescribed
for the treatment of certain disorders such as schizophrenia and bipolar
disorder.
The lawsuit alleges that Zyprexa has been
associated with an increased risk of developing diabetes, hyperglycemia,
pancreatitis, ketoacidosis and other injuries and that
Eli Lilly knew or ought to
have known that there were significantly increased risks of serious adverse
health complications caused by ingesting Zyprexa.
