British Columbia School Fees

A certification hearing has been scheduled for five days starting on
December 15, 2008 before Mr. Justice Groves. At the hearing, Poyner Baxter
LLP will be seeking orders, in part, that the action be certified as a class
action and the class be defined as follows:
All persons, resident in British Columbia, who claim to have been
billed fees by, and to have paid fees to, since January 1, 1990, a school or
a school board in British Columbia for goods and services necessary for a
student to complete the educational programs leading to graduation.

Poyner Baxter has today filed a class action lawsuit against the Province of
British Columbia alleging that the Plaintiff has been required to pay on behalf
of his children, course fees and various other fees which have been
unlawfully charged by the Defendant in contravention of the provisions of
the School Act.
The lawsuit claims that the Plaintiff, and all others in British Columbia who have paid
these school fees, are entitled to be reimbursed for all amounts paid to the
Defendant.
