Dyslexia Class Action

What can you do to be part of this action?

This action has been started as a putative class action pursuant to the Class Proceedings Act.  It will not become an actual class action until the court, on application by Poyner Baxter, certifies it as a class action pursuant to the Class Proceedings Act.

If and when it is certified as a class action, it will be certified as such on behalf of a defined group of people or class.  The definition, which we are proposing and which could be altered between now and then, is as follows:

"All students for whom, while resident in the Province of British Columbia, the Defendant has failed to provide proper testing and remedial education for their dyslexic condition."

As and when the case is certified on behalf of this class of individuals, anybody who comes within that definition will be automatically included in the lawsuit unless they take active steps to opt out.

In other words, there is nothing for you to do to become involved in the lawsuit.  You should simply await the certification and monitor our website for further information on the certification process.

Later on in the proceedings, if and when we get to the stage of dealing with individual claims, it will be necessary for class members to submit their claims.  A claims process will be developed and details will be found on our website at that time. This is substantially off in the future.
