On December 16, 2011 Poyner Baxter filed a proposed class action lawsuit against Rogers Communications Inc., Bell Canada Enterprises Inc., Telus Corporation, Fido Solutions Inc. and their various subsidiaries, on behalf of all persons in British Columbia who, when paying for wireless services, were improperly charged a "fee" variously described as a "systems access fee", "systems administration fee", "license administration fee" or "systems license administration fee" (the "System Access Fee").
The claim alleges that by separating the System Access Fee from other charges on their bills, the defendants knowingly and willingly misrepresented it as a tax or license fee for access to wireless communications services charged and collected on behalf of a third party government agency or body. It is alleged that the System Access Fee was not in fact a third-party tax or license fee but was a charge collected by the Defendants and retained for their own use.
